96条 (詐欺又は強迫)(Fraud or Duress) 

①詐欺又は強迫による意思表示は、

取り消すことができる。

Manifestation of intention which is induced by any fraud or duress may be rescinded.

②相手方に対する意思表示について

第三者が詐欺を行った場合においては、

相手方がその事実を知っていたときに限り、

その意思表示を取り消すことができる。【※第三者詐欺】

In cases any third party commits any fraud inducing any person to make a

manifestation of intention to the other party,

such manifestation of intention may be rescinded only if the other party knew such fact.

③前二項の規定による詐欺による意思表示の取消しは、善意の第三者に対抗すること ができない。

The rescission of the manifestation of intention induced by the fraud pursuant to the provision of the preceding two paragraphs may not be asserted against a third party without knowledge.
